Seized Russian AN-124 Aircraft to Serve Ukraine: ARMA’s Roadmap

The AN-124 aircraft, seized within a criminal proceeding and found by ARMA, must serve the national interest here and now.

Previously, ARMA established a dedicated working group comprising representatives of the Ministry of Justice, the Ministry for Communities and Territories Development of Ukraine, law enforcement agencies, the State Aviation Service of Ukraine, the Main Directorate of State Aviation of Ukraine, JSC “Ukroboronprom,” and JSC “Antonov.”

Pursuant to the instructions of the Prime Minister of Ukraine, the Asset Recovery and Management Agency developed a roadmap for synchronizing legislative procedures in Canada and Germany. The goal is to achieve the enforcement of the court decision and enable the management of the aircraft.

The mechanisms developed by ARMA reinforce Ukraine’s legal right to exercise control over the assets, enabling a parallel confiscation procedure in Canada and the recognition of the Ukrainian court decision in Germany.

Until the Canadian court proceedings confirm final ownership, which is required for registration and potential transfer to Ukraine, asset management is possible based on a national court decision legalized through international legal assistance procedures.

At ARMA’s request, the Office of the Prosecutor General has already contacted the Ministry of Justice, which, in turn, addressed the competent Canadian authorities. Institutional coordination among all stakeholders is expected to enhance procedural efficiency.
