The democratic model of public administration provides for the active participation of citizens and interest groups in the decision-making process. This requires the existence of appropriate legal mechanisms and procedures which, on the one hand, allow citizens to influence the decision-making process and, on the other hand, enable these decisions to be made quickly and effectively.

In accordance with the Law of Ukraine "On Citizens' Appeals", citizens may submit proposals to public authorities. A proposal is a citizen's appeal expressing advice or recommendations regarding the activities of state authorities and local self-government bodies, deputies at all levels, and officials, as well as opinions on the regulation of social relations and living conditions of citizens, the improvement of the legal basis of state and public life, and the socio-cultural and other spheres of activity of the state and society.

NOTIFICATION on the publication of a draft regulatory act – draft resolution of the Cabinet of Ministers of Ukraine "Certain issues concerning the selection of a manager of simple assets (assets)"

On 18 June 2025, the Verkhovna Rada of Ukraine adopted the Law of Ukraine "On Amendments to the Law of Ukraine "On the National Agency of Ukraine for Finding, Tracing and Management of Assets Derived from Corruption and Other Crimes" regarding the strengthening of the institutional capacity of the National Agency of Ukraine for Finding, Tracing and Management of Assets Derived from Corruption and Other Crimes, and improvement of asset management mechanisms" No. 4503-IX (hereinafter – Law No. 4503-IX), which came into force on 30 July 2025, introducing a number of amendments to the Law.

In accordance with Part 1 of Article 2 of the Law, the National Agency of Ukraine for Finding, Tracing and Management of Assets Derived from Corruption and Other Crimes (hereinafter referred to as the National Agency, ARMA) is the central executive body with special status that ensures the formation and implementation of state policy in the field of finding and tracing for assets that may be seized in criminal proceedings or in cases of recognition of assets as unjustified and their recovery as state revenue, and/or the management of assets seized in criminal proceedings or in cases involving the recognition of assets as unjustified and their recovery as state revenue, or which have been confiscated in criminal proceedings or recovered by court order as state revenue as a result of their recognition as unjustified.

Article 213 of the Law stipulates that the National Agency shall select the manager of a simple asset (assets) using an electronic procurement system in two stages:

1) preliminary qualification of participants;

2) determination of the manager of a simple asset (assets) by holding an auction among participants who have passed the preliminary qualification.

According to the Law, the procedure for preliminary qualification of participants for the selection of a manager of simple assets using an electronic procurement system, the procedure for maintaining a list of participants who have passed preliminary qualification, the procedure for conducting an auction, and the methodology for evaluating proposals are established by the Cabinet of Ministers of Ukraine.

In accordance with Article 9 of the Law of Ukraine "On the Principles of State Regulatory Policy in the Sphere of Economic Activity," ARMA announces the publication on the official website of ARMA of the draft resolution of the Cabinet of Ministers of Ukraine "On Approval of the Procedure for the Storage of Assets Taken into Management by the National Agency of Ukraine for Finding, Tracing and Management of Assets Derived from Corruption and Other Crimes" for the purpose of receiving comments and proposals from individuals, legal entities and their associations.

The draft resolution of the Cabinet of Ministers of Ukraine "On Approval of the Procedure for the Storage of Assets Taken into Management by the National Agency of Ukraine for Finding, Tracing and Management of Assets Derived from Corruption and Other Crimes" was developed with the aim of approving the Procedure for the storage of assets taken into management by the National Agency of Ukraine for Finding, Tracing and Management of Assets Derived from Corruption and Other Crimes. The storage of assets is carried out by the National Agency in compliance with the conditions necessary to preserve the properties of the assets, prevent the risks of their damage, loss, or encroachment on such assets.

For the purpose of storing assets, the National Agency has the right to:

1) conclude civil law contracts with business entities that have the necessary material and technical base, personnel with the appropriate professional skills and experience to ensure the proper storage of assets;

2) enter into civil law contracts with specialised organisations to ensure the protection of assets that need protection from external influences or risks of encroachment;

3) conduct an inventory of assets in order to check their condition and compliance with storage conditions

4) order expert opinions or consultations on assets with specific characteristics; 

5) take other measures necessary to ensure proper storage conditions for assets.

The National Agency shall determine the business entities and specialised organisations to be engaged for the storage of assets in accordance with the procedure established by the Law of Ukraine "On Public Procurement". The procedure for the storage of assets by the National Agency shall be approved by the Cabinet of Ministers of Ukraine.

The procedure for determining the valuation entity (competitive selection) provided for by the Procedure for competitive selection of valuation entities, approved by ARMA Order No. 78 of 23 March 2022, registered with the Ministry of Justice of Ukraine on 13 May 2022 under No. 515/37851, does not comply with the requirements of part two of Article 19 of the Law of Ukraine "On the National Agency of Ukraine for Finding, Tracing and Management of Assets Derived from Corruption and Other Crimes" (as amended by the Law of Ukraine "On Amendments to the Law of Ukraine "On the National Agency of Ukraine for Finding, Tracing and Management of Assets Derived from Corruption and Other Crimes" regarding the strengthening of the institutional capacity of the National Agency of Ukraine for Finding, Tracing and Management of Assets Derived from Corruption and Other Crimes, and the improvement of asset management mechanisms" dated 18 June 2025 No. 4503-IX), in connection with which there was a need to recognise ARMA Order No. 78 of 23 March 2022 as invalid, since currently the determination of the valuation entity must be carried out in accordance with the procedure established by the Law of Ukraine "On Public Procurement".

The regulatory act also proposes to establish that the determination of the valuation entity for the valuation of property transferred to ARMA for management shall be carried out in accordance with the procedure established by the Law of Ukraine "On Public Procurement" based on the results of open tenders, taking into account the requirements of Article 15 of this Law, with the relevant framework agreement being concluded for a term of no more than one year.

The Draft Order of ARMA "On Amendments to the Procedure for Competitive Selection of Valuation Entities" (hereinafter referred to as the Draft Order) has been published on the official website of ARMA on the Internet.

The Draft Order of ARMA has been prepared in accordance with part two of Article 21 of the Law of Ukraine "On the National Agency of Ukraine for Finding, Tracing and Management of Assets Derived from Corruption and Other Crimes", subparagraph 10-1 of paragraph 4 of the Regulations on the National Agency of Ukraine for Finding, Tracing and Management of Assets Derived from Corruption and Other Crimes, approved by Decree of the Cabinet of Ministers of Ukraine No. 613 dated 11 July 2018.

The Draft Order of ARMA "On Approval of the Procedure for Competitive Selection of Valuation Entities" (hereinafter referred to as the Draft Order) has been published on the official website of ARMA on the Internet.

The Draft Order of ARMA has been prepared in accordance with part two of Article 21 of the Law of Ukraine "On the National Agency of Ukraine for Finding, Tracing and Management of Assets Derived from Corruption and Other Crimes", subparagraph 10-1 of paragraph 4 of the Regulations on the National Agency of Ukraine for Finding, Tracing and Management of Assets Derived from Corruption and Other Crimes, approved by Decree of the Cabinet of Ministers of Ukraine No. 613 of 11 July 2018.

The main purpose of the Draft Order of ARMA is to define a clear list of documents to be submitted for participation in the competitive selection of valuation entities (hereinafter referred to as the Competition), the procedure for submitting such documents, the qualification criteria for applicants, their evaluation by a specially created commission on the competitive selection of valuation entities, decision-making, and determining the winner of the Competition.

In accordance with paragraph 17 of the Procedure for conducting public consultations on the formation and implementation of state policy, approved by Decree of the Cabinet of Ministers of Ukraine No. 996 of 3 November 2010, ARMA announces the publication on its official website of the Draft Law of Ukraine "On Amendments to the Criminal Procedure Code of Ukraine Regarding the Creation of a Systemic Legal Regulation of Relations for the Transfer of Seized Property to the Management of the National Agency of Ukraine for Finding, Tracing and Management of Assets Derived from Corruption and Other Crimes" (hereinafter referred to as the Draft Law) for the purpose of receiving comments and proposals from individuals, legal entities and their associations.

The Draft Law was developed with the aim of systematically regulating the transfer of seized property to ARMA.

Once adopted, the Draft Law will apply to asset owners who are suspects or accused of criminal offences, the prosecution authorities, pre-trial investigation authorities and ARMA employees.

In accordance with paragraph 17 of the Procedure for conducting public consultations on the formation and implementation of state policy, approved by Decree of the Cabinet of Ministers of Ukraine No. 996 of 3 November 2010, ARMA announces the publication on its official website of the Draft Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine Regarding the Implementation of the Principle of Priority of Criminal Arrest" (hereinafter referred to as the Draft Law) with the aim of receiving comments and proposals from individuals, legal entities and their associations.

The Draft Law was developed with the aim of eliminating current shortcomings in procedural legislation and providing a legislative basis for utilizing ARMA's potential in terms of compliance with and implementation of the principle of priority of criminal arrest.

The Draft Law proposes amendments to the Commercial Procedure Code of Ukraine, the Civil Procedure Code of Ukraine, the Code of Administrative Procedure of Ukraine regarding the implementation of the principle of priority of criminal arrest and the prevention of situations where ARMA is prevented from executing court orders to transfer assets to its management in criminal proceedings due to the use of instruments to secure claims in civil, commercial or administrative proceedings by the owners of such assets or third parties associated with them.

The Draft Order of the National Agency "On approval of forms of documents drawn up during the control of management efficiency" has been prepared in accordance with Article 22 of the Law of Ukraine "On the National Agency of Ukraine for Finding, Tracing and Management of Assets Derived from Corruption and Other Crimes" and the Procedure for Monitoring the Effectiveness of Asset Management, approved by Decree of the Cabinet of Ministers of Ukraine No. 351 of 10 May 2018.

The main purpose of the Draft Order is to standardise the forms of documents drawn up during the control of the effectiveness of asset management by the National Agency of Ukraine for Finding, Tracing and Management of Assets Derived from Corruption and Other Crimes.

In accordance with Article 25 of the Law of Ukraine "On the National Agency of Ukraine for Finding, Tracing and Management of Assets Derived from Corruption and Other Crimes" On 10 November 2015, No. 772-VIII, ARMA approved the Regulations on the Unified State Register of Assets Seized in Criminal Proceedings, the procedure for its formation and maintenance.

The Draft Order of ARMA "On Approval of the Regulations on the Unified State Register of Assets Seized in Criminal Proceedings" is published in accordance with Part Three of Article 15 of the Law of Ukraine "On Access to Public Information" dated 13 January 2011 No. 939-VI.

The democratic model of public administration involves the active participation of citizens and interest groups in the decision-making process.
