On 27 of September, the Head of ARMA Anton Yanchuk took part in the II International Legal Forum, which took place on September 25-28 in Kharkiv.
During the panel discussion "Effective system of criminal justice as a factor of sustainable economic development" Anton Yanchuk told to participants of the forum about the Agency, its key functions and interaction between the state, the owner of the asset and business. "ARMA is a unique example of the symbiosis for ensuring the interests of the state and promoting business development in Ukraine. Currently, the function of assets tracing works both in the interests of the state and in the interests of victims of crime. After all, the possibility of operative assets finding for the purpose of seizure is provided, prevention of loss of the property value and saving resources for the apparatus of the of pre-trial investigation authorities and the prosecutor's office", - Anton Yanchuk noted.
Describing ARMA's function on management of seized assets, he emphasized that for the state this function provides: termination of the possibility of financing the illegal activity by the owner, temporary filling of the state budget with the revenues from management, stopping the motivation of figurants in criminal proceedings to delay criminal proceedings, return into the economic circulation of the property immobilized by seizures. For the owner this function provides a single legitimate opportunity to dispose the seized property by granting consent for its transfer into management. For business - an opportunity to develop business in a new and promising market of seized asset management.
"The ARMA's function on management of seized assets is in fact one of the unique examples, when the public function of the state is absolutely dependent on the interest of the business to cooperate. If there is the interest of the business to become the manager of seized property - there is appropriate competition, there are better conditions. If there is no such interest, respectively, and terms of management of such asset are not too optimistic.
Therefore, one of ARMA's strategic functions is to maximize the interest of business to cooperate, become the managers of the seized assets, participate in our competitions and, accordingly, work in favor of the state, in favor of the owner, and, in fact, in favor of their own business ", - stressed Anton Yanchuk."
