The National Asset Recovery and Management Agency has completed a key stage in the transfer of seized property of LLC «Ukrayinsʹka yahoda» - officially signed acceptance certificates with the new manager. From now on, the production equipment and real estate of the company are managed by the Management Company CAMPARITET Consortium.
The acts were signed after the conclusion of the relevant management agreement, which was the result of an open tender procedure in the Prozorro system. This is the legal formalization of the actual transfer of the asset to the new manager.
"The transfer of this asset into management is a fundamental issue of justice and public efficiency. In this case, we are restoring control over assets that were previously used in a shadowy manner or in violation of the law," said Ihor Chuloi, Director of the Asset Management Department of the ARMA.
As a reminder, according to the decision of the Lychakiv District Court of Lviv, a significant amount of the company's property was transferred to ARMA, including corporate rights, production infrastructure and real estate with a total estimated value of almost UAH 6.5 million.
Before signing the agreement, ARMA faced opposition from the former owner of the asset in Zhytomyr region. A violation of a court injunction on the use of the property was found, which became the basis for opening criminal proceedings under Part 1 of Article 382 of the Criminal Code of Ukraine.
If so, the Agency managed to implement the mechanism for transferring the asset to management in accordance with the law. From now on, the state will begin to withhold a guaranteed payment of more than 64 thousand UAH from the management every month, and after the start of economic activity, 99.9% of the income from asset management will go to the State Budget of Ukraine, which leads to high efficiency of the transaction for the state.
