Staff of ARMA’s Central Office, led by Deputy Head Stanislav Petrov, with the involvement of employees from ARMA’s Western Interregional Territorial Office, conducted an on-site inspection of the seized assets of the “Polyana” and “Sonyachne Zakarpattya” sanatoriums. The inspection revealed a number of violations, which were subsequently referred to law enforcement authorities.
Polyana Resort
The integrated property complex of the “Polyana” resort includes several immovable property units. The asset was transferred to ARMA’s management by orders of the Pechersky District Court of Kyiv. Some seizure orders were subsequently cancelled; however, at ARMA’s initiative, the seizure of assets was reinstated each time.
An independent asset valuation and a review of the valuation report were conducted. The asset’s value, according to the assessment, is UAH 32.7 million. The asset was put up for competitive selection twice through the Prozorro electronic procurement system (May 15, 2024, and October 8, 2024), but the procedure did not take place due to participants submitting proposals in violation of the law. A new competitive selection has been announced in Prozorro (UA-2025-05-21-011034-a).
We also note that trade union organizations continue to exploit the assets without any legal grounds.
During the inspection the evidence was recorded of the illegal bottling of mineral water on the territory of the sanatorium by individuals associated of Aqua Polyana LLC and Krystalne Dzherelo LLC. The latter had a joint business agreement with the owner of the seized asset. It should be noted that for more than a year and a half, Aqua Polyana LLC has failed to comply with a court decision to vacate the premises of the mineral water bottling plant and return them to their lawful owner.
At the same time, Krystalne Dzherelo LLC is attempting to gain control over the asset by participating in a competition for the management of the Polyana sanatorium.
ARMA has officially informed law enforcement authorities about the revealed facts of illegal use of assets for the relevant procedural actions.
Sonyachne Zakarpattya Resort
The assets of the sanatorium were transferred to ARMA’s management by a decision of the Pechersky District Court of Kyiv. A competitive selection has already been held among appraisal companies, resulting in the conclusion of an appraisal agreement with TR Invest-Company LLC. ARMA is currently awaiting the appraisal results and preparing documentation to announce a competitive selection for a manager through Prozorro.
During the inspection, evidence was recorded of the illegal bottling of mineral water on the territory of the sanatorium by individuals associated with LLC “Recreational Technologies.” It was also documented that ARMA representatives were denied access to the premises, which constitutes a violation of the court decision and an obstruction of the Agency’s lawful activities.
These facts have also been the subject of an official referral by ARMA to law enforcement authorities regarding the illegal use of assets.
The National Agency will take all measures provided by law to ensure the proper management of seized assets, stop their illegal use, and protect the interests of the state.
