ARMA ensures legality and transparency in tender procedures for selection of managers of seized assets

The Asset Recovery and Management Agency (ARMA) has once again confirmed its legal position on the compliance of the terms of the tender procedures for the selection of managers of seized assets with the law.

The Antimonopoly Committee of Ukraine (AMCU) considered the complaint of LLC«Lebedyn Machine-Building Research and Experimental Plant TEMP» against the terms of the tender documentation formed by ARMA within the procedure for selecting an asset manager for LLC «Ukrtranspevmatika».

The complaint of LLC «Lebedyn Machine-Building Research and Experimental Plant TEMP» concerned the amount of the minimum guarantee payment set by ARMA for the future manager. The AMCU Commission postponed the date of the decision three times during the consideration of the complaint and requested additional explanations and documents. After reviewing all the case materials, the Commission issued a decision dismissing the complaint in its entirety.

This is yet another confirmation that the National Agency's tender procedure was conducted in accordance with the law, and the tender was organized in compliance with the principles of transparency and fair competition. ARMA is conducting the tender for the manager in strict compliance with the law, in particular with regard to the determination and justification of the minimum guarantee payment, calculated in accordance with legal requirements and principles of effective asset management.

ARMA will continue to be a reliable guarantor of legality and transparency in the process of transferring seized assets into management, ensuring maximum economic efficiency and public interest.
