According to the decision of the Lychakiv District Court of the city of Lviv, the corporate rights, production facilities and property of LLC «Ukrayinsʹka yahoda» were transferred to the Asset Recovery and Management Agency (ARMA). The specified court decision established a ban on the use and disposal of the asset for the owners of this enterprise.
Prior to the inspection of the seized asset, the law enforcement authorities had recorded in advance with the relevant procedural acts the obstruction and illegal activity of the company's employees.
Employees of the Central Apparatus and the Central MTU ARMA together with representatives of the National Police in Zhytomyr region, despite the opposition: inspected the asset, recorded illegal activity and failure to comply with the court order.
Thus, based on the results of ARMA's procedural actions, law enforcement officers submitted information to the EDPR pursuant to Part 1 of Art. 382 (Non-execution of a court decision) of the Criminal Code of Ukraine.
In addition, on the territory of the enterprise, in the seized premises, for a long time, families of Roma nationality lived, who, taking advantage of their vulnerable state, were used by the organizers of illegal activities for harvesting. To avoid attracting attention, a sign with the inscription "Punkt Nezlamnosti" was placed at the entrance to the enterprise. ARMA employees also informed the migration police about this fact.
At the same time, ARMA has already announced a competition to find an appraiser for LLC " Ukrayinsʹka yahoda ". The contest will last until August 21. The next stage is the selection of an effective manager of this asset in order for the state to receive monthly direct revenues to the budget from the management of seized property.
