At the request of the Assets Recovery and Management Agency, AMCU provided advisory clarifications regarding the application of the provisions of Articles 22, 23, 24, part 1 of Art. 27 and Part 3 of Art. 30 of the Law of Ukraine "On the Protection of Economic Competition" to relations related to the transfer of assets to management in accordance with the Law of Ukraine "On the National Agency of Ukraine on Identification, Search and Management of Assets Obtained from Corruption and Other Crimes".
The committee explained that, in accordance with the provisions of the current legislation, ARMA should apply with a joint application together with the participants of the concentration for granting permission for the transfer of assets to management in case of exceeding the threshold indicators specified in Article 24 of the Law "On the Protection of Economic Competition"
Also, the Committee recommended the application of shortened terms for consideration of applications for granting a concentration permit, within the terms specified by the Law "On the Protection of Economic Competition". From now on, consideration of an application for granting permission for concentration in the form of transfer of assets to management in accordance with the Law "On ARMA" will be carried out within 25 days from the date of its receipt. At the same time, if the asset requires an additional market evaluation, the term of consideration of the AMCU case will be up to two months.
Clarifications provided by the AMCU will give ARMA the opportunity to receive the conclusions of the AMCU as soon as possible and to enter into contracts for the management of seized assets in order to speed up the receipt of funds to the state budget of Ukraine.
