With the participation of members of the public, Members of Parliament, lawyers, experts, insolvency officers and private enforcement officers, the National Agencyheld an open discussion of legislative initiatives aimed at strengthening ARMA'swork and improving the mechanisms for managing seized assets.
Currently, three draft laws are under consideration: governmental draft law № 12374 (developed by ARMA and submitted by the Ministry of Justice of Ukraine) and twoalternative draft laws, including those that propose to implement a fundamentallynew mechanism for managing seized assets with the participation of insolvencyofficers.
“We deliberately gathered the widest possible range of experts to hear differentprofessional positions. Our goal is to create the most transparent and efficientmechanism for managing seized assets. We are interested in hearing all expertopinions and professional positions,” said Head of ARMA Olena Duma.
Particular attention was paid to alternative draft laws that propose to introduce anasset management mechanism with the participation of insolvency receivers. Theparticipants agreed to analyze in detail the potential benefits and risks of such anapproach.
In addition, «Yurydychna Praktyka» («Legal Practice») publishing house expressedits readiness to become a platform for broad discussions on the issue of legislativestrengthening of ARMA. In particular, the publishing house plans to develop a separate section where everyone will be able to get informed about the position ofrepresentatives of the Parliamentary Committee on Anti-Corruption Policy, ARMA and the public on the necessary changes.
ARMA will continue to engage as many professional and expert stakeholders aspossible to improve its work in a transparent and legislative manner, ensuringmaximum openness in the process of discussing legislative initiatives.
