ARMA has developed a draft law on asset seizure planning: the document is already under consideration by the Government

Assets Recovery and Management Agency (ARMA) proposes to improve the procedure for preparing a request for the transfer to the management of assets that may be seized in criminal proceedings. The relevant draft law has been submitted to the Government for consideration. It is aimed at improving the effectiveness of asset transfer processes in order to preserve their economic value. The draft law provides for changes in the Criminal Procedure Code of Ukraine and other legislative acts.

In particular, the draft law plans:

Early planning: Prosecutors will be able to consult with ARMA on the possibilities of effective property management. This will help to choose an effective method of management (management / realization) of seized assets at the planning stage.

Improvement of information exchange: It is proposed to create a special electronic system for operational data exchange between ARMA, the prosecutor's office and pre-trial investigation bodies.

Clarification of the property transfer procedure: The draft law provides for clearer and more detailed rules for the transfer of seized property to the ARMA administration, which should reduce the number of disputed situations and speed up the transfer process.

Thanks to the initiative of the Agency, it is expected to improve the efficiency of the preservation and management of seized property due to more prompt response and maximum interaction between ARMA and law enforcement agencies.

"ARMA, as a policy-making body in the field of management of seized assets, continues to improve legislation and implement the best international standards. Our initiative is aimed at strengthening interdepartmental cooperation, which will improve the efficiency of the management of seized property, which is transferred to the National Agency by a court decision, and will reduce opportunities for obstructing its management. We count on the Government and the Parliament to support these changes as soon as possible," emphasized ARMA Deputy Chairman Pavlo Velikorechanin.

After approval by the Government, the draft law will be registered in the Verkhovna Rada of Ukraine, where it will be considered by a specialized committee. Next - voting in the session hall of the parliament.

The agency has already implemented practices and mechanisms for working with law enforcement agencies through joint pre-arrest planning orders.
