On October 11, 2023, Head of the Asset Recovery and Management Agency, Olena Duma, reported on the key achievements for 100 days in charge.
During this period, ARMA has achieved the following results:
- On August 25, ARMA opened public access to the Unified State Register of Assets Seized in Criminal Proceedings. The Register has become an impetus for transparency and openness of data on seized assets and their management. The number of entries in it has already crossed the 150,000 mark (about 49,000 of which have been transferred into Agency`s management).
- ARMA has significantly improved the efficiency of seized assets management.
Examples:
- Crytex-Service LLC, the Manager of “Vinnytsyapobutkhim”, transferred more than UAH 7.7 million to the budget in a single August 2023
- PJSC "Ukrnafta" will transfer 85% of its net profit from the management of V. Medvedchuk's Glusco filling station network. The minimum guaranteed monthly payment is UAH 5 million
- PJSC Ukrnafta transfer 90% of profit from asset management
- For 100 days, the budget revenues from the management of seized assets amounted to UAH 30,133,167, which is almost the same as the state treasury revenues for the entire 2022 (UAH 34.8 million)
- During the reporting period, ARMA initiated the purchase of War Bonds twice as much as in 2022 (almost UAH 2.5 billion). In total, the Agency initiated their purchase for over UAH 3.7 billion
- In 3 months, the Agency secured UAH 2,002,781,131 in deposits with Oschadbank, which is 370% more than in the first half of 2023. The total amount on ARMA's deposit accounts now stands at UAH 3,646,939,765
- In 100 days, ARMA carried out 83 control measures (more than 300 movable and immovable property objects were inspected). The agency terminated management agreements with inefficient managers who did not bring adequate revenues to the budget (NJSC "Naftogaz Ukraine", "Sof Marine", "Atlant Rent", etc.). Inspections of Chornomornaftogaz (26 of Firtash's regional gas companies) are underway, and an interagency working group with law enforcement agencies has been set up to effectively monitor and take appropriate actions
- As the initiator of Draft Law No. 6233, the Agency appealed to the Cabinet of Ministers of Ukraine, the Verkhovna Rada of Ukraine and the President of Ukraine to urgently adopt this draft law to unblock the management of seized corporate rights. The opening of the Unified State Register of Assets Seized in Criminal Proceedings revealed 1064 records of seizure of 100% of corporate rights, the management of which requires approval from the owners of corporate rights
- ARMA initiated draft laws on the transfer of health resort facilities for rehabilitation of the servicemen, for use by the state and for military needs
- The Agency has initiated changes to the sanctions mechanism regarding the possibility of selling assets already into ARMA's management
- ARMA approved the Guidelines for conducting a competitive selection of managers for seized assets in accordance with public procurement legislation. The Agency has also developed and submitted to the Cabinet of Ministers of Ukraine Amendments to the Procedure for the Sale of Seized Assets, which regulate the procedure for sale on Prozorro and provide for the possibility of selling assets located outside Ukraine
- The Agency approved the Anti-Corruption Programme for 2023-2025
- ARMA establishes Anti-Corruption Council
- The Cabinet of Ministers of Ukraine has approved the Asset Recovery Strategy for 2023-2025 developed by ARMA. ARMA established an Interagency Working Group to work on the implementation of the Strategy
- Since July 2023, the Agency's management team has been renewed: by 35% (B1) and 30% (B3).
- Working in 37 open and closed bases, ARMA officers processed 1,956 appeals from Ukrainian law enforcement agencies in 100 days
- In 100 days, ARMA has found and traced (in Ukraine and abroad) UAH 3.56 billion (cash); USD 312.5 million; EUR 194.2 million; corporate rights worth UAH 53 billion; 5,837 residential and non-residential properties and other assets
- ARMA continues to identify and trace the assets of sanctioned persons. Results for 100 days: UAH 94.98 million (cash); corporate rights worth UAH 4.6 billion; 108 residential and non-residential properties and other assets
- The Agency intensified cooperation with the world's largest cryptocurrency exchanges to identify digital and virtual assets, and initiated the creation of a new profession - "Digital Detective" (jointly with the NAQA)
- ARMA continues fruitful cooperation with 88 countries and 54 international institutions, in particular with CARIN, StAR, Interpol, Europol, Task Force UA and others
- The Agency was admitted to the Steering Group of BAMIN (Balkan Asset Management Interagency Network) for the first time. In addition, on August 11, 2023, ARMA joined the SIENA platform.
"I am absolutely convinced that in these 100 days the Agency has achieved significant results in its daily activities," said Head of ARMA, Olena Duma. - "The Agency will continue to achieve even more significant successes, proportionate to the challenges facing the country and the nation. The key tasks for ARMA by the end of this year and for 2024 are to ensure the return of foreign seized assets (primarily russian) to Ukraine; to improve the legislation that regulates the work of ARMA; to improve the Register; to ensure effective management of seized property; to significantly increase the amount of revenues to the state budget and, in general, to increase the capacity, status, prestige and trust to the Agency."
