A working meeting of the Head of Asset Recovery and Management Agency, Olena Duma, was held with representatives of LLC Crytex-Service, the manager of the "Vinnytsiapobuthim" plant.
After the court transferred the assets of "Vinnytsiapobuthim" to the management of ARMA in 2022, the company stopped production. In order to establish effective management of seized property, ARMA announced a competition for the search of a manager. The winner was announced as the company "Krytex-Service".
Currently, LLC Crytex-Service pays 7.5 million hryvnias to the state budget every month, and the quality and efficiency of property management are regularly checked by employees of the ARMA division. Thus, according to the information of the LLC, in 2023 the manager paid 51 million hryvnias to the state budget, including 39 million hryvnias according to the management contract. In 2024, this amount has already reached 36.4 million hryvnias, of which 25 million hryvnias are under the management contract. Thus, for the entire period of management, more than 87 million hryvnias were transferred to the budget.
A meeting was supposed to take place yesterday regarding the consideration of the lawsuit of the Ministry of Justice of Ukraine to the High Anti-Corruption Court (HCC) regarding the application of sanctions to the Russian JSC "Nevskaya Kosmetika". However, the consideration of this claim was postponed.
Representatives of LLC " Crytex-Service" noted that the company currently employs more than 100 people - these are jobs for residents of the Vinnytsia region. Granting the Justice Department's lawsuit would result in production shutdowns and job losses that are important to preserve in a wartime environment.
The implementation of the decision of the Central Administrative Court, determination of the method of further disposal of already state assets, preparation and holding of the auction will lead to a stoppage of production for a period of about half a year.
During the meeting, the parties discussed urgent problematic issues related to the termination of asset management in the event of collection of such assets into state revenue (receipts to the budget of Ukraine, provision of tax revenues, provision of employment to the population, etc.).
The manager, who has already brought more than 87 million hryvnias to the state budget, pays taxes and wages to the workers of the Vinnytsia region, focused attention on the anxious moods of both the workers themselves and the local authorities. The corresponding letter of appeal has already been submitted to the agency, because the suspension of the existing management contract, which is already working for the state, will create not only the actual shutdown of the enterprise, but also the actual launch of management in a new circle.
In fact, this example clearly demonstrates the imperfection of last year's amendments to the Law of Ukraine "On Sanctions". ARMA constantly emphasizes and appropriate changes have been made regarding the mandatory extension of existing contracts for the management of seized assets (the owners of which are duplicated in the sanction list).
Thus, the issue of the procedure for asset management in the period between the entry into force of the VAKS decision and the subsequent announcement of the auction winner is an acute issue that needs to be resolved.
