Today, Prozorro will host an auction to select a manager for the Gulliver shopping center

The Asset Recovery and Management Agency (ARMA) would like to draw the attention of all potential managers to the fact that today an auction for the selection of a manager of the Gulliver shopping center will be held on the Prozorro platform.

ARMA starts the year 2025 with the auction of an asset that should provide sustainable significant revenues to the state budget of Ukraine in the amount ofhundreds of millions of hryvnias.

The Gulliver case attracted media attention throughout 2024.

The ARMA faced opposition from persons related to the owner. ARMA employees were denied access to the site, complaints, lawsuits, and orders.

ARMA has gone through the entire public procurement procedure. It inspected the asset, conducted market consultations as part of the competitive selection of managers, competitively selected an independent appraiser, and provided the appraiser with all the necessary conditions for the appraisal, which resulted in a report on the value of the Gulliver shopping center at UAH 7.6 billion.

After the announcement of the tender procedure on the Prozorro platform, ARMA faced the fact that some interested participants repeatedly tried to challenge the qualification criteria set by ARMA and use all possible mechanisms to delay and postpone the auction date. For example, identical complaints were filed and the complainants were related.

During the tender procedure, 16 requests for clarification of the procedure were filed, which ARMA reviewed in a timely manner and provided substantiated responses.

13 complaints were filed with the Antimonopoly Committee of Ukraine (AMCU), which is currently a kind of anti-record. None of the tender procedures announced by the ARMA on Prozorro for the selection of the manager caused such a resonance.

It should be noted that 9 out of 13 complaints were left by the AMCU without consideration because the complaints filed did not meet the requirements of the law. One complaint was dismissed on the grounds that the complainant's rights had not been violated, 3 complaints were upheld by the AMCU and ARMA complied with these decisions, ensuring the rule of law in the procedure.  

Thus, from now on, the qualification requirements in the tender procedure are the actual result of ARMA's work, taking into account the AMCU's decisions, which ensures 100% compliance with the requirements of public procurement legislation.

We believe that this excitement was due not only to the owner's desire to retain influence over the expensive asset, but also to the fact that the tender will be attended by honest and solvent bidders who will provide significant revenues to the state budget. So, we are following the auction and looking forward to the new manager of one of the largest shopping malls in the capital.
