Attempts to block the tender for management of the Gulliver shopping center: ARMA exposes unfair schemes

ARMA continues its systematic work on the management of seized assets, despite constant attempts by the owners to block this process. The recent case of the tender for the management of the «Gulliver» shopping center clearly demonstrates the methods of such counteraction.

After ARMA made changes to the tender documents in accordance with the AMCU's decisions of December 10 and published them on the Prozorro platform, 3 new complaints were received on December 12. It is noteworthy that the analysis revealed an attempt to manipulate the appeal process.

It was found that the complaints, which were identical in content, were filed on behalf of two different companies LLC «STAR INVESTMENT VAN» (EDRPOU 42682150) and the Consortium Management Company «ESPLANADNA»(EDRPOU 45902470). At the same time, both complaints were signed on behalf of one person LLC «STAR INVESTMENT VAN».

Further investigation revealed that:

- LLC «STAR INVESTMENT VAN» is the founder of the Consortium of MC «ESPLANADNA»

- The founders of the Consortium also include LLC «ZHYTLO UYUT SERVICE».

- Director of LLC «ZHYTLO UYUT SERVICE» is one of the founders of the Consortium

It is worth noting that it was LLC «STAR INVESTMENT VAN» and LLC«ZHYTLO UYUT SERVICE» that filed the complaints on November 13 and 14, which were partially satisfied by the AMCU. At the same time, more than 4complaints of other participants were left without consideration, and one was withdrawn by the complainant.

Such actions clearly demonstrate a systematic attempt to block the legitimate process of managing seized assets. It is especially unacceptable that this is happening under martial law, when filling the state budget is critical for the country.

ARMA continues its work despite the opposition and calls on all market participants to compete transparently and fairly in the interests of the state.
