ARMA has a clear plan to strengthen Ukraine's sanctions policy - Olena Duma

Olena Duma, Head of ARMA, spoke about the role of the National Agency in Ukraine's sanctions policy and the plan to strengthen it, the implementation of HACC decisions, the search for sanctioned assets abroad and the purchase of government bonds for seized funds at the XV KYIV CRIMINAL LAW FORUM.

“The purchase of military bonds by the National Agency for seized funds has already become one of the tools of Ukraine's sanctions policy. 2 billion UAH of PinUp, 18 million USD of Friedman and Avenston. Friedman and Aven, 1.8 billion UAH and 3.5 million USD of Royal Pay - all these Russian funds are now working for the state's defense capability. However, the sanctions policy should be more effective, and ARMA has already developed the necessary changes for this purpose,” said OlenaDuma.

The Head of the ARMA said that the National Agency has already developed draft law No. 10069, which:

Allows ARMA to manage the corporate rights of the aggressor state and its affiliates without obtaining their permission. This will provide new billions of dollars in revenues to the state budget.
It will also enable ARMA to sell sanctioned assets that have already been transferred to ARMA's management within the framework of criminal proceedings.Olena Duma gave an example of existing legislative conflicts on the example of «VinnytsiaPobutkhim», which was managed by ARMA and transferred to the SPFU for sale by the decision of the HACC.

According to her, the National Agency has already traced assets abroad worth about 100 billion USD.

However, in order for the state to receive income from them to the state budget, it is necessary to amend Article 545 of the Criminal Procedure Code. These changes are intended to allow the ARMA to directly address foreign authorities with requests for international legal assistance (MLA) in the area of asset recovery and management. After all, when a state body is obliged to execute a court decision and this result depends on the competence of another body, it should be unified. That is why ARMA is ready to assume responsibility and bring the execution of decisions to an effective result.

“Our goal is to increase the speed and effectiveness of international cooperation in the enforcement of national court judgments by allowing ARMA to play a more active role in coordinating asset recovery efforts in different jurisdictions. At the same time, it will also strengthen close cooperation with the PGOs and other law enforcement agencies and speed up the procedures that society and the state expect. Only together we can achieve the necessary results for the state,” summarized Olena Duma.
