ARMA protects not only the state's interests, but also the rights of legal owners

As part of its duties, the National Agency reviewed the application of the legal owner and decided to return the funds to him due to the enforcement of a court decision cancelling the seizure of the funds transferred into management.

In order to comply with the decision to cancel the arrest, UAH 1 million 278 thousand and USD 15.4 thousand will be returned to Liberty Finance LLC, including more than UAH 300 thousand of interest accrued by the bank.

Thus, the Agency ensures that the legal owner not only preserves the funds, but also increases their effective value. "Consider ARMA as a reliable bank," says Head of the National Agency Olena Duma. 

Based on the results of its decision, the Agency sent the relevant case materials to the ARMA Anti-Corruption Council for a position statement. After that, the actual transfer of funds will be made to the bank accounts of the legal owner, Liberty Finance LLC.

ARMA, as a public authority, acts and will act exclusively in accordance with the provisions of the current legislation, within the limits and in the way of powers defined by the Law. At the same time, when it comes to enforcing a court decision to return funds to Russian citizens, ARMA is guided by the CMU Resolution No. 187 of 3 March 2022 "On protection of national interests in future claims of the state of Ukraine due to Russia's military aggression" and the SSU's warnings.

In wartime, there is a moratorium on the enforcement of monetary and other obligations in favour of individuals or legal entities of the russian federation.

"In order to protect Ukraine's national interests, the Agency will never return funds to those citizens and legal entities of the russian federation that carry out illegal activities in the temporarily occupied territories of Ukraine, in particular in Crimea," said Olena Duma. According to Ms Duma, in case of legislative collisions, ARMA sends materials on all related cases to the Anti-Corruption Council.

As a reminder, the next meeting of the ARMA Anti-Corruption Council is scheduled for Friday, April 12.
