Not every attack is the best defence. Pressure on ARMA will not work

15-03-2024

Since mid-2023, ARMA has been developing and implementing a new regulatory framework that ensures transparent competitions for managers. At the same time, active work is underway to monitor the performance of the managers, including their financial performance.

In addition, ARMA regularly conducts desk and on-site inspections of property management. The results of these inspections are published on the official website for transparency and openness.

In particular, the results of control measures that revealed violations in the activities of both public and private managers have recently been made public. This resulted in payment of additional amounts to the state budget and disciplinary action against persons responsible for such violations.

At the same time, during the desk audits of the management results of "RC"VOZDVIZHENKALTD", were identified a number of composition inconsistencies and the amount of income and expenses in accordance with the terms of management agreements and legislation. This was the reason for a more detailed analysis of the identified facts.

In response, the manager sent an appeal to the prosecutor's office, stating that for the first time in 5 years, ARMA had not approved his expenses of more than UAH 3 million, and also pointed to the Agency's alleged inaction in the form of not signing additional agreements to extend the term of the management contracts.

ARMA emphasises that it ensures and will continue to ensure compliance with the law in the asset management of all managers and declares that any pressure on the Agency is unacceptable.

ARMA's Asset Management Performance Monitoring Department will continue its work within the framework of the law and ensure that all asset managers comply with the requirements of the law, including indicators and information about violations in previous periods and their verification.
