Olena Duma: Seized funds should be transferred to ARMA for management and work for the benefit of Ukraine

At the initiative of the Asset Recovery and Management Agency (ARMA), a working meeting was held with representatives of the Specialized Anti-Corruption Prosecutor's Office. The issues discussed included the transfer to ARMA of seized assets that are the subject of a dispute over the recognition of unjustified assets and their recovery for the benefit of the state.

The Head of ARMA, Olena Duma, has already reported on the expediency of transferring seized funds to the National Agency so that millions of dollars are not kept in safes but can work for the state and support the Ukrainian defense forces:

“ARMA should manage unjustified assets that can be recovered as state revenue before the seizure is lifted. Cases can drag on for years, and this mechanism will ensure stable revenues to the state budget from illegally acquired assets,” said Duma.

Earlier, to establish systematic cooperation, a meeting was held with the High Anti-Corruption Court and an appeal was sent to the Supreme Court to form a unified practice of transferring assets to the Agency for the management of cases of recognizing them as unjustified. Thus, the mechanism exists and is provided for by the Civil Procedure Code of Ukraine (Articles 153 and 290 of the CPC of Ukraine), but it is not applied and ARMA does not receive the decisions the state needs.

In order to resolve these issues, ARMA initiated a meeting with the parties to the process, in particular, the SAPO prosecutors who have the function of preparing motions to the court to transfer unjustified assets to ARMA. During the meeting, the mechanism of such interaction was discussed in a working order to launch an effective system of transferring assets for management to the National Agency.  

It should be noted that by transferring such assets to the management of ARMA, each confiscated hryvnia will be able to work for the defense and economy of Ukraine, the state will preserve and increase the value of the seized assets.

“In this situation, all state bodies must work systematically and with a united front to ensure the state's interests,” summarized the Head of ARMA Olena Duma.
