Anti-Corruption Policy Committee of the Verkhovna Rada of Ukraine recommended members of parliament to adopt as a basis the government's draft Law of Ukraine "On Amendments to Article 21 of the Law of Ukraine "On the National Agency of Ukraine for Finding, Tracing and Management of Assets Derived from Corruption and Other Crimes" to improve the efficiency of asset management" (Reg. No. 11009 of 12.02.2024).
The draft law aims to regulate asset management during martial law and in peacetime by improving sanctions policy and increasing the efficiency of state, municipal property and seized assets management.
The draft proposes the need to apply a simplified procedure for transferring to management in the presence of at least one of the following circumstances:
- Accommodation of internally displaced persons in order to implement state social programmes;
- providing military personnel and members of their families with residential premises;
- rehabilitation of military personnel, including those discharged from military service as a result of illnesses related to the performance of military service, and war veterans;
- ensuring the readiness of state authorities to implement measures to protect the sovereignty of the state and its defence capability, as well as civil protection tasks in a special period, in particular during the period of martial law.
It is provided that the Cabinet of Ministers of Ukraine no later than 5 business days from the date of receiving relevant information from the National Agency shall instruct the ministry or other central executive body responsible for the formation and/or implementation of state policy in the area in which at least one of the above circumstances exists and/or to which the relevant assets belong, to hold consultations on the appointment of the relevant company as the manager of such assets.
Following the consultations, the relevant ministry or other central executive authority, in consultation with the National Agency, submits a draft decision to the Cabinet of Ministers to transfer assets into management due to the existence of one of the above circumstances.
