Yesterday we talked about the receipt of another tranche of 77 million hryvnias to the state budget from the administration of "Oblgaz Firtash". Already today, another 34 million hryvnias have been provided by the Agency for Search and Asset Management to the state treasury from the sale of mineral fertilizers (urea granulated) through the Prozorro. ARMA is additionally engaging expertise on the compliance of the sales with the market price: in the near future, samples and samples of lots of granular urea, which are put up for sale, will be taken. By the way, we note that, taking into account the fact that the seized asset has been stored for more than a year, the total price from the sale of these assets of more than 34 million hryvnias is estimated to be quite good, while also paying 9 million hryvnias in customs payments.

Permanently National Agency independently monitors the compliance of price offers of lots with market prices. The Agency draws attention to the fact that when announcing an asset for the first electronic auction, the current legislation of Ukraine on public procurement allows business entities to use a mechanism that lowers the price of the lot. Usually, business entities, knowing about the peculiarities of this mechanism, deliberately do not submit their applications at the first announcement of bidding, waiting for a re-announcement when, according to the procedure, the price of the lot is reduced by 50%. At repeated tenders, the Agency has already observed the competitiveness and initiative of the participants, who fight among themselves for the acquisition of the asset, raising the price.

We call on deputies, "Prozorro.Prodazhi" and electronic platforms together with ARMA to improve the mechanism by which this practice of deliberately lowering the price will be eradicated. By amending the Procedure for the sale of seized assets, it is possible to create conditions under which participants in electronic auctions will compete and fight for the acquisition of seized assets during the first, and not repeated, auctions.

It is also worth noting that according to the norms of the current legislation of Ukraine, the Agency cannot advertise and invite participants to participate in auctions, as this is a corruption risk. So, there is something to think about together with representatives of Prozorro. Prodazhi and  deputies of Ukraine regarding increasing competitiveness at the first auctions, so that the participants fight for the acquisition of the asset not at half price, but at the initial starting price of the market value.
