Today, People's Deputies of Ukraine Miroshnychenko I.V., Sidorovych R.M., Kozachenko L.P. and Danchenko O.I. visited ARMA, exercising their right to urgent admission on matters of deputy activity stipulated in part two of Article 16 of the Law of Ukraine "On the Status of People's Deputy of Ukraine".
Upon proposal of the People's Deputies in the course of the meeting with the Head of ARMA some issues related to the criminal proceeding
No. 12017150170000012 from January 14, 2017 were discussed. The chief investigating department of the National Police of Ukraine carries out the pre-trial investigation of this criminal proceeding on the fact of fraudulent takeover of the proprietary and corporate rights of the “NEST” plant in the Mykolaiv oblast.
In this criminal proceeding only the immovable property of the plant, seized and transferred into the management of ARMA was found to be valid evidence. During the meeting, the Deputies emphasized the need for preservation of the relevant plant as a functioning enterprise.
According to ARMA's practice, effective management of an existing enterprise is possible upon transfer of not only immovable property but of an integral property complex with the whole set of immovable and movable property in its composition, as well as shares in the authorized capital of the legal entity-owner of the enterprise.
In this connection, it was clarified that ARMA does not have discretionary powers to independently choose what to manage, and cannot request from the bodies of pre-trial investigation and the prosecutor's office to seize something and transfer it into management.
At the same time, ARMA accepted the relevant deputy's appeal, confirmed readiness for its consideration and provision of an answer within the terms set by the law.
